Agreeing to these terms
These terms cover the community layer of Cracked Buckeye: voting, flagging, and adding notes, photos or suggested edits. Reading the site needs no agreement at all. Creating an account, or checking a box that says you agree, means you accept these terms.
Who can create an account
You must be 18 or older to create an account or contribute to Cracked Buckeye. Reading the site, and voting or flagging a fact, need no account and no age check.
Your account
You agree to give us accurate details when you sign up and to keep them up to date. One person keeps one account; do not create a second account after being banned, and do not share an account with anyone else. You are responsible for keeping your password safe, and for anything done through your account. Tell us right away at hello@crackedbuckeye.com if you think someone else has access to it.
What happens to what you contribute
You keep ownership of every note, photo and suggested edit you contribute. By submitting one, you confirm you have the right to share it, and you grant Cracked Buckeye a perpetual, worldwide, royalty-free licence to publish it, adapt it (resize a photo, correct a typo, shorten a note) and redistribute it as part of the site.
Once approved, your text and photos are published under Creative Commons CC BY 4.0, credited to your public name, the same as the rest of the site's open content. That means anyone can reuse them with credit to you, even after you delete your account.
What you may not post
- Anything false or misleading, presented as fact.
- Anything that harasses, threatens or attacks another person.
- Private information about another person: their address, phone number, or anything else not already public.
- Advertising, spam, or a link whose main purpose is to sell something.
- A photo you do not own and do not have permission to share.
- Anything illegal, or anything that infringes someone else's copyright or other rights.
Moderation and removal
Every contribution is reviewed before it appears. We may reject, edit for length or clarity, or remove anything, at our discretion, including after it has been published, and we may suspend or ban an account that breaks these terms. We try to explain why, but we do not owe an explanation or a warning before we act.
Copyright complaints
If you believe something on Cracked Buckeye infringes your copyright, email hello@crackedbuckeye.com with:
- the copyrighted work you claim is infringed;
- the material you believe infringes it, and its URL on this site;
- your contact information;
- a statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law;
- a statement, made under penalty of perjury, that the above is accurate and that you are the copyright owner or authorized to act on their behalf;
- your physical or electronic signature.
We will remove or disable material that a valid notice identifies. If you contributed the material and believe it was removed by mistake, you can send a counter-notice with your name and contact information, an identification of the material and where it appeared before removal, a statement under penalty of perjury that you believe it was removed by mistake or misidentification, and a statement that you consent to the jurisdiction of the federal court for your district (or, outside the United States, an appropriate judicial district) and will accept service from the person who filed the original complaint. We may restore the material after a counter-notice unless the original complainant tells us they have filed a court action.
No warranty
Cracked Buckeye is provided as is, with no warranty of any kind. Nothing on this site, sourced or from the community, is professional advice about your water, your health, the law, or a property you own or are considering. For a decision that matters, check with a professional and with the primary source.
Limitation of liability
To the fullest extent the law allows, Cracked Buckeye and Open Shower Co are not liable for any damage arising from your use of the site or your reliance on anything in it, sourced or contributed by the community.
Governing law
These terms are governed by the laws of the State of Ohio, without regard to its conflict of law rules.
Changes to these terms
We may update these terms as the community layer grows. The version below is the one in effect when you agreed to them. If we make a material change, we will update this page and the version line, and, where practical, tell account holders by email.
